The agreement between you and Focuz. Please read it before using the App.
These Terms of Service ("Terms") form a binding agreement between you and Coderiftz ("Coderiftz," "we," "us," or "our"), the operator of Focuz, governing your access to and use of the Focuz mobile application (the "App"). By downloading, installing, creating an account with, or otherwise using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.
Focuz is a focus timer and app-blocking application that helps you track focus sessions, block distracting apps during those sessions, and, optionally, compare progress with friends or a global leaderboard through virtual rewards ("Focuz Coin"), streaks, and performance scores. Features may be added, modified, or removed over time.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create a Focuz account. By creating an account, you represent that you meet this requirement and that all information you provide is accurate.
When using Focuz, you agree not to:
Certain features require you to grant Android system permissions (Usage Access, display-over-other-apps, notifications, camera/gallery, and others), as described in detail in our Privacy Policy. You may decline or revoke any permission at any time; doing so may limit or disable the corresponding feature, but will not disable the App as a whole.
Focuz Coin, streaks, badges, and performance scores are virtual, in-app recognitions of focus activity. They:
If you choose to use friends or leaderboard features, your display name, profile photo, Focuz Coin balance, streak, and rank become visible to other users as described in our Privacy Policy. You can leave the global leaderboard or remove friend connections at any time from the App's settings. We may remove, hide, or restrict a user's leaderboard presence at our discretion where we reasonably believe these Terms have been violated.
Focuz is currently free to download and use. We reserve the right to introduce optional paid features, subscriptions, or in-app purchases in the future. If we do, pricing and terms specific to those offerings will be presented to you clearly before any charge, and your continued use of free features will not be affected.
The App, including its name, logo, design, source code, and all associated content (excluding your User Content, defined below), is owned by Focuz and protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms don't grant you any rights to our trademarks, branding, or underlying technology.
"User Content" means any name, username, or profile photo you upload or set within the App. You retain ownership of your User Content. By setting it within the App, you grant Focuz a limited, non-exclusive, royalty-free license to display it to other users as needed to operate friends and leaderboard features (for example, showing your name and photo to a friend). You're solely responsible for ensuring your User Content doesn't infringe on the rights of others or violate Section 5.
You may stop using the App at any time. You can delete your account and its data yourself from Settings → danger zone → Delete account in the App, or, if you've already uninstalled it, via our account deletion page or by emailing mrinalx3@gmail.com. We may suspend or terminate your access to account-dependent features if we reasonably believe you've violated these Terms, engaged in fraud or abuse of the scoring/leaderboard systems, or created risk or legal exposure for Coderiftz or other users. Where practical, we'll make reasonable efforts to notify you of the reason.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don't guarantee that app-blocking features will be 100% effective on every device, Android version, or OEM configuration, or that the App will be uninterrupted, timely, secure, or error-free. Focuz is a productivity tool, not a substitute for professional advice regarding attention, mental health, or medical conditions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOCUZ AND ITS DEVELOPERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) 50 USD. Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold Focuz and its developers harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your User Content, or your misuse of the App.
These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless otherwise required by mandatory consumer-protection law in your place of residence. Any dispute arising from these Terms or the App will be subject to the jurisdiction of the competent courts of India, except where the law of your country of residence gives you the right to bring proceedings in your local courts.
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you don't agree to updated Terms, you should stop using the App and may delete your account.
